So, for those that may wonder about Victory Canteen:
18 U.S. Code § 713 - Use of likenesses of the great seal of the United States

The important parts:

The Law said:
"(a) Whoever knowingly displays any printed or other likeness of the great seal of the United States, or of the seals of the President or the Vice President of the United States, or the seal of the United States Senate, or the seal of the United States House of Representatives, or the seal of the United States Congress, or any facsimile thereof, in, or in connection with, any advertisement, poster, circular, book, pamphlet, or other publication, public meeting, play, motion picture, telecast, or other production, or on any building, monument, or stationery, for the purpose of conveying, or in a manner reasonably calculated to convey, a false impression of sponsorship or approval by the Government of the United States or by any department, agency, or instrumentality thereof, shall be fined under this title or imprisoned not more than six months, or both."

In other words, you can't use the seal with the intent of making people think you are sponsored by the government.

Further,  

The Law said:
"(b) Whoever, except as authorized under regulations promulgated by the President and published in the Federal Register, knowingly manufactures, reproduces, sells, or purchases for resale, either separately or appended to any article manufactured or sold, any likeness of the seals of the President or Vice President, or any substantial part thereof, except for manufacture or sale of the article for the official use of the Government of the United States, shall be fined under this title or imprisoned not more than six months, or both."

In other words, you cannot reproduce the seal except as provided by executive order.

And lastly (bold by me),

By virtue of the authority vested in me by section 713(b) of title 18, United States Code, I hereby prescribe the following regulations governing the use of the Seals of the President and the Vice President of the United States:

Section 1. Except as otherwise provided by law, the knowing manufacture, reproduction, sale, or purchase for resale of the Seals or Coats of Arms of the President or the Vice President of the United States, or any likeness or substantial part thereof, shall be permitted only for the following uses:
(a) Use by the President or Vice President of the United States;
(b) Use in encyclopedias, dictionaries, books, journals, pamphlets, periodicals, or magazines incident to a description or history of seals, coats of arms, heraldry, or the Presidency or Vice Presidency;
(c) Use in libraries, museums, or educational facilities incident to descriptions or exhibits relating to seals, coats of arms, heraldry, or the Presidency or Vice Presidency;
(d) Use as an architectural embellishment in libraries, museums, or archives established to house the papers or effects of former Presidents or Vice Presidents;
(e) Use on a monument to a former President or Vice President;
(f) Use by way of photographic or electronic visual reproduction in pictures, moving pictures, or telecasts of bona fide news content;
(g) Such other uses for exceptional historical, educational, or newsworthy purposes as may be authorized in writing by the Counsel to the President.

Sec. 2. The manufacture, reproduction, sale, or purchase for resale, either separately or appended to any article manufactured or sold, of the Seals of the President or Vice President, or any likeness or substantial part thereof, except as provided in this Order or as otherwise provided by law, is prohibited.

The question is, did BGW harm the office of the President by using the seal? I suspect not, so it is unlikely that anyone would prosecute the alleged crime. Further if they did, would this stand up stand up against Judicial review? Frankly if got that far, I suspect this current court would find in favor of the defendent. They tend to favor corporations, awarding them, rights as individuals and freedom of speech.
 
Of course it is, and someone should be fired for that. (I'm looking at you Scott.) Further, the design team is probably libel as well; I'm not sure how that contract would hold up. Frankly, the contract side of this potentially con-law issue makes my little MBA heart beat with excitement! Almost as much as a good hostile takeover!
 
Lucky for us SeaWorld Parks & Entertainment doesn't care to fire people for breaking the law, either. ASCAP licenses for public performances, plagiarism of other productions, using songs without the artist's permission, unlawful use of the likenesses of the great seal of the United States and just being stupid. Oh, wait, being stupid isn't against the law. It should be, but would it matter to SeaWorld anyway?
 
Walked by the bar/grill for the first time last Monday.

- The grill looks 100% better without the ugly crepe paper things covering it. I don't understand who thought the original idea was a good one. It looks more permanent at least.
- The bar looks fine in person.
- Columns still look tacky with the streamers. Get rid of those.
- Who thought it would be a good idea to stick a glow stand underneath water misters?
- Get rid of those ugly star thingies and the banner over the San Marco entrance. It looks awful.
- Music selection is fine for July 4th, but not for anything afterward. Play it at night near fireworks time, but keep the regular park music on during the day.
 
I don't know if they heard us, or what, but they moved the glow stand. It is no longer under the mister, it is in front of that round sculpture thing. Across from the little bald eagle stage. The walk way is very cramped now.
 
Oh look, another beautiful piece of San Marco covered up for this tacky Patriotic glitter event. Am I surprised? No.
 
That Watermelon Frozen Martini is good - but watermelon is definitely not the taste I would associate with that drink. (For those who are of age to enjoy whatever it tastes like)
 
FUN FACT: The fireworks cost at least twice as much more as Imaginique. They last 1/4 as long as Imaginique. They show about half the summer than Imaginique. Don't ever happen twice in one night like Imaginique. Employ a lot less people than Imaginique. More "Bang" for your buck? Don't think so.

comparing 1.4 to 1.3 smart. comparing a price point from 10 years ago. smart. good comparison though
