You're not though. You're a normal, everyday guest. Who are you to tell the park what level of supposed legal risk they should take?
I agree with the rest of your post. But I feel as though this kinda contradicts the very nature of this website, as the vast majority of us are unqualified yet give our opinions on things out of our area of expertise.

You're not wrong, but that armchair analysis starts to get sort of absurd when we're judging internal legal risk assessments and extrapolating from that guess work that the park was being irresponsible.

I also think there are much better ways to present criticism than insinuating that the park was being negligent or reckless. "I hope to hear an automatic spiel show up before the ride officially opens. These things help protect BGW from litigation and the like." is a far more reasonable way to present that criticism than state that the ride shouldn't have been allowed to open.

Which legally isn't required in Virginia for amusement rides. The rides just need to have an automated spiel that can play when needed at the board operator's discretion.
 
I find all this talk of safety spiels over the last few pages interesting. It's very funny to me how often enthusiasts know so little about the rides they think to be self-proclaimed experts about. Safety spiels are almost never automatically attached to a ride cycle, they're typically started by push button by an operator. Operators are given a choice to use these "auto spiels" or spiel the ride themselves. As to the question of height checks, I wouldn't be surprised if there are unmarked posts or poles in the queue to estimate the height of children who need to be pulled aside and accurately measured.
 
I am a 5’ 10” male weighing close to 300 pounds. Will I be able to fit on Finnegan’s Flyer. I can fit on all rides in park except for Griffin and Alpengeist. Because of forum comments on InvadR, I decided to try it and fit just fine even though test seat will not go green. Thanks

I'm about 5' 10" 250 lbs and I had plenty of room, somewhere in the range of 4-6 clicks
