This is a standard tactic in personal injury lawsuits. There is often a time limit for filing a claim after an incident. (Say three years.) If you file too soon, this gives the people you are suing a chance to file a counter suit. <You hurt me by your negligence.> <You are hurting us by filing a frivolous lawsuit.> If the first party waits 2 years and 364 days to file their suit, the other party doesn't have time to file a counter suit before the deadline expires.
