I would figure BGW would be above board on the legal end of things - maybe it it was that previous counsel was a bit more conservative for Nessie's 40th.
Although it is interesting to know that Busch owned both the brewery and park, I guess technically they operate as separate legal entities... Which would make the argument for the park funded by beer money instead of it's own income a bit suspicious. However, reading the Busch family history book exposed that the beer company wasn't too concerned with any perceived violations of these laws for quite some time.
Either way, there's now free beer in the park so that's a good perk, even if it is Blue Moon for time being.
