Ead told reporters after the accident that a tree branch hit him in the head as he rode the coaster, leaving him bleeding.

The lawsuit, filed by attorney Barry Novack, seeks money to cover legal costs, medical bills and lost earnings.

Novack recently filed a suit against Disneyland Resort on behalf of an Anaheim man who said he was hurt in an accident on Splash Mountain. The jury found Disneyland negligent in the accident but said the accident was not a substantial factor in the man's injury.

Well...should have saw that coming.

While I understand them wanting the park to pay for medical bills and legal cost, they are hurting their case by saying the vehicle wasnt safe. They are lucky it hung there for as long as it did. Plus, i'm pretty sure the park would/will pay their medical bills if they would have just gone directly to them. But of course now that legal is in the mix, shit gets all messy. Guess they just want their 15min of fame.

Either way, I doubt the park will hardly pay anything. This is what their insurance is for. Now if they can prove negligence, which is doubtful, that's another story.

Six Flags isn't allowed to open rides if the ride envelope is occupied by something during morning inspections. Bizarro at Great Adventure has had a few delayed openings due to tree branches being within arms reach by the Cobra Roll. It's a freak accident, not negligence.
